What Quippy is

Quippy is a daily practice space for hard conversations. You step into scenarios, try lines, and get feedback after each session. Quippy is not therapy, is not a replacement for professional support, and is not a substitute for talking to the actual people in your life.

These terms ("Terms") are a binding agreement between you and Quippy App, Inc. ("Quippy", "we", "us") covering your use of the Quippy mobile app, the website at quippyapp.com, and any related features (together, the "Service"). If you do not agree to these Terms, do not use the Service.

Eligibility and accounts

You can use Quippy if you are at least 16 years old and able to enter into a binding contract where you live. If you are under the age of majority in your jurisdiction, a parent or legal guardian must review these Terms with you.

You are responsible for keeping your account credentials private and for any activity that happens under your account. Do not share your account with other people. Tell us promptly if you suspect someone else is using your account.

What we provide

The Service gives you scenarios, scene partners, feedback, and a curriculum that adapts to your patterns over time. Scene partners and feedback are generated with the help of language model providers. We work to keep the Service reliable, but it may occasionally be unavailable for maintenance, fixes, or factors outside our control.

We may add features, change features, or remove features at our discretion. If a change materially reduces functionality you rely on, we will try to give you reasonable notice.

Your content

Everything you write or say inside a Quippy session, along with any feedback you submit, is "Your Content". You keep ownership of Your Content.

You grant Quippy a limited, worldwide, royalty-free license to host, store, process, and display Your Content for the sole purpose of operating the Service for you. That includes generating scene partner responses, producing your feedback, shaping the curriculum that Quippy suggests to you, and keeping a history of your sessions so you can review your own progress. The license ends when you delete Your Content or your account, subject to short backup retention windows described in our privacy policy.

We do not sell Your Content, and we do not use Your Content to train models for anyone else. See the privacy policy for the full picture of how Your Content is handled.

You are responsible for Your Content. Do not include material that is illegal, that infringes someone else's rights, or that you do not have permission to share.

Acceptable use

You agree not to:

  • Use the Service to harm yourself or anyone else, or to plan such harm.
  • Use the Service to harass, threaten, stalk, defame, or impersonate anyone.
  • Upload content that is unlawful, sexually explicit involving minors, or that infringes intellectual property, privacy, or publicity rights.
  • Probe, scan, or test the vulnerability of the Service, or attempt to bypass authentication, rate limits, or access controls.
  • Reverse engineer, decompile, scrape, or otherwise try to extract our source code, prompts, weights, or underlying systems, except where this restriction is prohibited by law.
  • Use the Service to build a competing product, train another model, or generate content meant to deceive or harm anyone.
  • Resell, sublicense, or share access to the Service, or use the Service through an automated agent without our written consent.
  • Interfere with other users, our infrastructure, or the integrity of the Service.

We may investigate suspected violations and take any response we think is appropriate, including warning you, removing content, limiting features, or suspending or terminating your account.

Subscriptions, billing, and refunds

Parts of the Service may require a paid subscription. Prices, billing periods, and trial terms are shown at the point of purchase. Subscriptions purchased through the Apple App Store are billed by Apple under your Apple ID, and they renew automatically until you cancel.

You can cancel a subscription at any time in the App Store. Cancellation takes effect at the end of the current billing period; you keep access until then. Refunds for App Store purchases are handled by Apple under Apple's media services terms. We can answer questions about your subscription, but we cannot process App Store refunds directly.

If we ever offer paid features outside the App Store, the billing terms for those features will be shown at purchase and incorporated into these Terms.

Our intellectual property

The Service, including the Quippy name, mascot, illustrations, software, prompts, curriculum design, and all other materials we create, is owned by Quippy or our licensors and is protected by intellectual property laws. These Terms do not transfer any ownership of the Service to you.

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms. You may not use Quippy branding without our written permission.

We welcome feedback. If you send us suggestions or ideas about the Service, you grant us a perpetual, royalty-free license to use them, with no obligation to you.

Third-party services

The Service relies on third parties for hosting, payment processing, analytics, error reporting, language model inference, and similar functions. Your use of the Service is also subject to those providers' terms where they apply. We list the categories of providers we rely on in our privacy policy.

The Service may link to third-party sites or content. We are not responsible for that content, and linking is not an endorsement.

Beta and experimental features

We sometimes label features as beta, preview, or experimental. Those features may be incomplete, unreliable, or removed without notice. They are provided as-is and may have different privacy, performance, or availability characteristics than the rest of the Service.

Account and cancellation

You can stop using Quippy at any time. You can delete your account from inside the app, or by emailing hello@quippyapp.com. Deletion removes Your Content from the live Service within a reasonable period and from backups on the schedule described in our privacy policy.

We may suspend or terminate accounts that violate these Terms, that pose a safety risk, that we are required to terminate by law, or that have been inactive for an extended period. If we ever sunset the Service, we will give you reasonable notice and a way to export Your Content.

No medical or therapeutic claims

Quippy is a practice tool, not a clinical product. We do not diagnose, treat, cure, or prevent any medical or mental health condition. Nothing in the Service is medical or psychological advice.

If you are in crisis or thinking about harming yourself or someone else, please contact a qualified professional or a local crisis line right away. In the United States you can dial or text 988 to reach the Suicide and Crisis Lifeline. Quippy is not designed to respond to emergencies and should not be used as a substitute for therapy or other care.

Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will produce specific results in your relationships or conversations. Scene partner responses and feedback are generated content and may be inaccurate, incomplete, or unsuitable for your situation. Use your own judgment.

Limitation of liability

To the fullest extent permitted by law, Quippy and our officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising out of or related to the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim related to the Service is limited to the greater of one hundred US dollars or the amount you paid us for the Service in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold Quippy harmless from any claim, demand, or damages, including reasonable legal fees, arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third party right.

Disputes and governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before filing a formal claim, please email hello@quippyapp.com and give us a chance to resolve the issue. If we cannot resolve it informally, any dispute will be brought in the state or federal courts located in San Francisco County, California, and you and Quippy consent to personal jurisdiction there. You and Quippy each waive any right to a jury trial. Where the law allows, claims must be brought individually and not as part of a class action.

Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction for actual or threatened infringement of intellectual property or misuse of confidential information. If you live in a jurisdiction whose laws give you stronger consumer protections that cannot be waived, those protections still apply.

Apple App Store terms

If you downloaded the Quippy iOS app from the Apple App Store, the following also applies:

  • These Terms are between you and Quippy, not Apple. Apple is not responsible for the app or its content.
  • Your license to use the app is limited to use on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
  • Quippy, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar laws.
  • Quippy, not Apple, is responsible for investigating, defending, and resolving any third-party intellectual property claim relating to the app.
  • You represent that you are not located in a country subject to a US government embargo, and that you are not on any US government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to these terms

We may update these Terms when the product, our practices, or the law changes. If an update is material, we will let you know inside the app or by email before it takes effect. Continued use of the Service after an update means you accept the updated Terms. If you do not accept them, you should stop using the Service.

Miscellaneous

These Terms, together with the privacy policy and any other terms referenced at purchase or in the Service, are the entire agreement between you and Quippy about the Service. If a provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. You cannot assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger or sale of our business. Notices to you may be sent to the email address associated with your account or posted in the Service.
